Quebec’s Bill 68 – Medical Certificates January 23 2025

On October 9, 2024, Québec's Bill 68 was enacted to alleviate the administrative workload of physicians, allowing them to concentrate more on patient care by reducing administrative tasks. However, the Bill also affects employers by limiting their ability to request documentation for certain employee absences. Specifically, for the first three absences of three days or less within a 12-month period due to sickness or other specified reasons, employers cannot demand written justification, including medical certificates. For family-related absences, while documentation can be requested, medical certificates cannot be specifically required, regardless of the absence's duration. Employees are entitled to up to 10 days per year for family obligations, provided they attempt to minimize the leave's impact.

The Bill's amendments, effective January 1, 2025, do not affect employers' rights to request documentation for other types of leave, such as compassionate care or bereavement leave.
