Ontario to Introduce New “Pay Transparency” Bill March 07 2018
The Ontario government unveiled a new bill that, if passed, would introduce new recruiting requirements aimed at reducing gender-based wage discrimination.
The new bill would require that publically advertised job postings include a salary range. Further, employer would now be barred from asking questions about an employee’s, or prospective employee’s, past compensation. Lastly, the bill would also prohibit employers from punishing employees for discussing or disclosing their compensation with others.
At first, these new rules would only apply to Ontario’s public service employers. Gradually, the new rules would be phased in to include employers with more than 500 employees; then, employers with more than 250 employees.
The new legislation will also include new tools to aid employers in tracking and reporting compensation gaps in their organization based gender and other characteristics.

L'Ontario pourrait adopter un nouveau projet de loi sur « l’équité salariale homme-femme »
Le gouvernement de l'Ontario a dévoilé un nouveau projet de loi qui, s'il est adopté, créera de nouvelles exigences en matière de recrutement ayant pour but de réduire la discrimination salariale en fonction du sexe.
Le nouveau projet de loi exigerait que les offres d'emploi annoncées publiquement comprennent une échelle salariale. De plus, l’employeur ne serait plus autorisé à poser des questions sur la rémunération antérieure d'un employé ou d'un employé éventuel. Enfin, le projet de loi interdirait également aux employeurs de pénaliser les employés pour avoir discuté ou révélé leur rémunération avec d'autres.
Tout d’abord, ces nouvelles règles ne s'appliqueraient qu'aux employeurs de la fonction publique de l'Ontario. Graduellement, les nouvelles règles seraient introduites progressivement pour inclure les sociétés comptant plus de 500 employés, puis les employeurs avec plus de 250 employés.
La nouvelle législation comprendra également de nouveaux outils pour aider les employeurs à effectuer le suivi et à signaler les écarts de rémunération en fonction du sexe et autres caractéristiques dans leur organisation.
