Smoke-Free Ontario: What Employers Should Know June 06 2018
On July 1, 2018, the Smoke-Free Ontario Act, 2017 will come into effect. This act will consolidate both the Electronic Cigarettes Act and earlier publications of the Smoke-Free Ontario Act. Obligations under this Act include, but are not limited to:
- Ensure no person smokes or holds a lighted tobacco/medical cannabis/electronic cigarette and/or consumes a designated product or substance in a designated area or an enclosed workspace;
- Give notice to all employees in the enclosed workplace/designated area of the above prohibition;
- Remove all ashtrays from enclosed workplace or designated area (except in vehicles in which ashtrays have been previously installed);
- Ensure that a person who refuses to comply with the prohibitions does not remain in the enclosed area or workplace.

Ontario sans fumée : ce que les employeurs doivent savoir
La Loi de 2017 favorisant un Ontario sans fumée entrera en vigueur le 1er juillet 2018. Cette loi consolidera à la fois la Loi sur les cigarettes électroniques et les publications antérieures de la Loi favorisant un Ontario sans fumée. Les obligations prévues par la présente loi comprennent, sans toutefois s'y limiter :
- Veiller à ce que personne ne fume ou ne tienne une cigarette électronique de tabac / de cannabis médical allumée, et ne consomme une substance ou un produit désigné dans une zone délimitée ou dans un espace de travail fermé;
- Aviser tous les employés dans le lieu de travail fermé ou la zone délimitée de l'interdiction ci-dessus;
- Retirer tous les cendriers du lieu de travail fermé ou de la zone délimitée (sauf dans les véhicules dans lesquels des cendriers ont déjà été installés);
- Veiller à ce qu'une personne qui refuse de se conformer aux interdictions ne demeure pas dans la zone délimitée ou le lieu de travail fermé.
